1. GENERAL INFORMATION

The Platform is owned by OHAI Marbella, S.A. (hereinafter, "Camping Marbella Playa"), a company incorporated under Spanish law, with registered address at Carretera Nacional 340, Km. 192.800, 29600, Marbella – Málaga, Tax ID (CIF) A29108107, registered in the Mercantile Registry of Málaga.
2. CONDITIONS OF USE
Browsing and using the Platform makes you a user thereof and implies your acceptance of all provisions included in this Legal Notice, as in force at the time of each access. If you do not wish to accept or comply with the conditions described herein, please leave the Platform immediately.
This Legal Notice shall apply regardless of any particular conditions that Camping Marbella Playa may establish for specific services and/or content, which must be accepted by the user prior to the provision of the corresponding service, or of any applicable General Terms and Conditions.
Access to and/or browsing of the Platform is free of charge.
Should you be required to enter personal data in the forms available on the website, such data must be truthful, accurate and up to date. Camping Marbella Playa will process your data in accordance with the Privacy Policy.
3. INTELLECTUAL AND INDUSTRIAL PROPERTY
The user undertakes to use the content and services made available on the Platform – including, without limitation, texts, graphics, images, icons, technology, software, links and other digital, audiovisual or audio content, as well as graphic design and source code (hereinafter, "Content") – in accordance with applicable law, this Legal Notice, and any usage regulations and instructions provided. In particular, the user undertakes to refrain from:

- Removing, manipulating or otherwise altering the copyright notices and other identifying data of Camping Marbella Playa or third parties;
- Exercising or abusing exploitation rights associated with such content, unless expressly authorised by the legitimate rights holder and, where applicable, subject to the conditions expressly agreed.
All trademarks, names, distinctive signs, content architecture (design, navigation, ordering and taxonomy of the Platform and its content, etc.) and content or software of any kind incorporated in the Platform are the property of Camping Marbella Playa or third parties. Use of or access to the Platform and/or its content or services shall not be construed as granting the user any rights over such trademarks, trade names and/or distinctive signs, or over any other elements made available through it.
In summary, content and services are subject to the intellectual or industrial property rights of Camping Marbella Playa or third parties, and no rights therein are transferred to the user beyond what is strictly necessary for the correct use of or access to the Platform and its services and content (personal, non-sub-licensable use, given the nature of the service and applicable legal requirements).
Should the user, in the course of accessing or using the Website, incorporate or export any content protected by intellectual or industrial property rights, the user acknowledges or undertakes to obtain in advance all necessary authorisations to ensure that Camping Marbella Playa may use such content without hindrance.

Users of the Platform are PROHIBITED from:

- When establishing a hyperlink to the Platform, reproducing or linking to specific content without the written authorisation of Camping Marbella Playa; hyperlinks may only point to the homepage.
In the event of breach of these prohibitions, and from the moment Camping Marbella Playa becomes aware of such breach, we may warn you of the need to cease such activities, request their immediate removal or correction, or directly remove or block such content. We may also suspend, deactivate or delete your user account, if applicable, without giving rise to any right to monetary compensation.
5. EXCLUSION OF WARRANTIES AND LIABILITY
- Camping Marbella Playa does not guarantee the availability and continuity of the Platform and its services, whether its own or those of third parties. Where reasonably possible, prior notice of interruptions will be given.
- Camping Marbella Playa does not guarantee that content is free from viruses or other elements that may affect your system, although it will take the necessary measures to prevent and remedy such issues.

In all the above cases, Camping Marbella Playa disclaims liability for any damages or losses that arise or may arise, to the fullest extent permitted by applicable law, whether towards the user or third parties.
6. APPLICABLE LEGISLATION AND JURISDICTION
This Legal Notice is governed in all its aspects by Spanish law. Any dispute relating to this Legal Notice shall be submitted to the Courts and Tribunals of Madrid, unless applicable regulations establish the jurisdiction of other courts. Where the user qualifies as a consumer, the courts of the user's place of domicile shall have jurisdiction.
7. SEVERABILITY
If any provision of this Legal Notice is declared null or invalid, the remaining provisions shall continue to be valid and binding. Waiving compliance with a provision on any given occasion does not imply waiver of the remaining provisions or the granting of additional rights.
8. AMENDMENTS TO THE LEGAL NOTICE
Camping Marbella Playa reserves the right to modify, at any time, the presentation and configuration of the Platform, as well as this Legal Notice. We recommend that, each time you access the Platform, you carefully read this Legal Notice, as it may be amended for legal, technical or corporate reasons.
