GENERAL BOOKING TERMS AND CONDITIONS

These General Booking Terms and Conditions (hereinafter «General Terms» or «GBT»), together with the online booking form and any Specific Conditions that may be indicated, constitute the agreement between OHAI Marbella, S.A. (hereinafter «Camping Marbella Playa» or «we») and any user interested in our services (hereinafter «the User» or «you»), accessible through the website https://www.campingmarbellaplaya.com.

We urge you to read these General Terms carefully before making any booking, as they constitute a binding contract between the Parties.

When submitting the online booking form, you must tick the box «I have read and accept the privacy policy and the processing of my personal data». By ticking it, you confirm that you have read these General Terms, declare your acceptance of them, and give your express consent to all the content of the contract in the version published at the time of acceptance, committing to comply with it without reservation.

The User

A natural person identified through the data provided in the online booking form, who is responsible for the accuracy, currency, and completeness of such data. The User declares to be at least eighteen (18) years of age and to have legal capacity to enter into contracts. Parents and legal guardians are responsible for all acts or damages caused by minors in their custody during the stay.

2. Subject Matter

These GBT govern the terms and conditions applicable to the booking by the User of camping pitches (hereinafter «the Pitch») at Camping Marbella Playa, managed by OHAI Marbella, S.A., through the website https://www.campingmarbellaplaya.com/.

Use of these online booking services constitutes an agreement between the Parties with full and unconditional acceptance of all clauses of these GBT, without the need for a written transcription.

Excluded from the subject matter of this contract are any additional services provided by third parties that the User may independently engage during their stay (catering, sports activities, etc.).

3. Booking Process

The User may make a booking through the website https://www.campingmarbellaplaya.com/, specifying the dates of stay, the selected pack, the number of guests, and any required extras.

A booking shall only be binding on Camping Marbella Playa once the User has received the corresponding confirmation. Requests that have not been expressly confirmed do not create any obligation for either Party.

Camping Marbella Playa reserves the right to decline booking requests where availability does not exist or where justified reasons apply, without this giving rise to any right to compensation for the User.

Check-in is from 14:00 and check-out by 12:00, unless otherwise expressly agreed. Reception is open from 08:00 to 22:00.

4. Payments

To guarantee the booking, at the time of confirmation Camping Marbella Playa will ask the User to enter their credit or debit card details through an external secure payment service provider. Card data is processed directly by that provider using tokenisation in compliance with PCI DSS standards; Camping Marbella Playa does not store full card data at any time.

Access to the campsite for accommodation purposes is conditional upon presentation of a valid credit card at check-in. Without a valid credit card it will not be possible to formalise access or make the booking effective, regardless of whether it has been previously confirmed.

On arrival, a €70 hold will be placed on the credit card of the reservation holder as a deposit covering cleaning and pitch condition. Such a hold does not constitute an effective charge and will be released within the usual bank processing timeframe once it has been verified that the pitch is in appropriate condition at the end of the stay. Should the pitch show damage or inadequate cleaning attributable to the User, Camping Marbella Playa reserves the right to execute the hold in whole or in part.

As a general rule, the total amount of the stay will be charged upon arrival at the campsite. However, the card details captured at the time of booking are linked to the reservation and may be used to apply the cancellation policy set out in clause 5 of these GBT, without any further action required from the User.

Applicable rates are those in force at the time of booking confirmation and include VAT in accordance with Spanish legislation. Prices are stated in euros. Any supplement or additional service not included in the booked pack shall be paid directly by the User at current rates.

The User declares that the payment method provided is valid, is held in their name, and has sufficient funds or credit. Camping Marbella Playa reserves the right to verify the validity of the card via a pre-authorisation prior to arrival. If the card proves invalid or the charge is declined, the booking may be automatically cancelled, without prejudice to the provisions of the cancellation policy.

5. Cancellation Policy

Cancellation conditions depend on the season in which the booking falls:

Notice periods shall be calculated in calendar days from the date of the cancellation notification (as confirmed by email acknowledgement) to the expected arrival date. For a cancellation to take effect, the User must notify it to reservas@campingmarbellaplaya.com.

The financial retentions provided in this clause shall apply to the total amount of the reserved stay, including all booked packs and extras. The retained amount will be applied against the payment due on arrival or, where a prepayment or card guarantee has been provided, will be charged to that payment method.

Booking modifications (change of dates, pack, or number of guests) are subject to availability and may result in price adjustments in line with current rates. Camping Marbella Playa reserves the right to treat a change of dates as a cancellation and new booking where this is appropriate under the conditions above.

6. Data Protection

The personal information and data provided by the User will be processed by OHAI Marbella, S.A. in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR), and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

All persons staying at the campsite must carry valid and current personal identification documents to verify:

In accordance with the Andalusian regulations on camping establishments (Decree 26/2018 of 23 January on the regulation of tourist campsites), Camping Marbella Playa is required to register guests' identification data and, where applicable, to communicate it to the competent authorities.

The User acknowledges and declares that all information provided is truthful and accurate.

7. Limitation of Liability

Except as expressly described in these GBT and to the extent permitted by law, Camping Marbella Playa shall not be liable for damages of any kind arising from the inaccuracy, incompleteness, or lack of currency of the information on the website, including errors or omissions.

Camping Marbella Playa shall likewise not be liable for damages arising from force majeure or fortuitous events (including adverse weather conditions, supply interruptions, health restrictions or governmental orders), nor for damages caused by third parties outside its sphere of action.

The User is responsible for complying with the campsite's internal regulations, the house rules, and applicable legislation on camping establishments in Andalusia. Failure to comply may result in immediate termination of the booking contract without right to a refund.

9. Dispute Resolution

Any dispute arising from these GBT shall be submitted to the Courts and Tribunals of Marbella (Málaga), unless consumer protection legislation establishes the competence of other Courts and Tribunals. Where the User has consumer status, the applicable jurisdiction shall be that of their place of residence.

A User with consumer status may voluntarily resort to accredited alternative dispute resolution bodies for consumer matters under Law 7/2017 of 2 November, without prejudice to their right to pursue judicial proceedings.

If any clause of these GBT is declared null or void, the remaining clauses shall not be affected and shall remain in force. The affected clause shall be replaced by one that, in compliance with the law, most closely reflects the original intention of the Parties.
